Terms of service

These terms are an agreement between you and the operator of GAMSAT Pro (legal entity to be confirmed) [to be confirmed: legal entity, registered address, company number] for the use of GAMSAT Pro. By creating an account or buying a plan you accept them. If you do not agree, please do not use the service.

1. The service

GAMSAT Pro is an online practice product for the GAMSAT. It offers practice units with hints and explanations, timed practice blocks, writing practice with AI-generated qualitative feedback, and progress history. Features and the size of the question bank change over time; we describe what is included on the pricing page.

GAMSAT Pro is an independent product. It is not affiliated with or endorsed by ACER (the Australian Council for Educational Research), which owns the GAMSAT trademark. Our questions are original practice material and are not official GAMSAT questions.

2. No guaranteed results

Practice results in GAMSAT Pro are not GAMSAT scores and do not predict them. We do not guarantee any score, admission or other outcome. Official information about the test, registration and dates comes only from ACER.

3. AI-generated content

Questions are drafted with AI and checked by automated tests and independent review before publication (see how we write and check questions). Writing feedback is generated by an AI model. Despite these checks, content can contain errors. If you find one, tell us at support@gamsatpro.com and we will review it.

4. Your account

You must be at least 18, give accurate information and keep your sign-in secure. Accounts are for one person; do not share them. You are responsible for activity under your account.

5. Plans, payment and renewal

• Free tier: limited access as described on the pricing page, with no payment details needed.
• Monthly plan: billed monthly in advance until you cancel. You can cancel at any time from the billing page (“Manage billing” opens Polar's customer portal); access continues until the end of the period you have paid for, and there are no partial refunds for that period except as set out in the refund policy or required by law.
• Until-your-exam pass: a single payment for access until results are released for the sitting you chose, plus 7 days. If official dates for an estimated sitting turn out later than our estimate, access is extended to the new results date at no cost; it is never shortened. The pass does not renew.
• Who sells and who charges you: paid plans are sold through Polar (Polar Software, Inc., polar.sh), our merchant of record. Polar is the seller of record for your purchase: it processes the payment, calculates and collects VAT or GST for your country, and issues your receipt and invoice. Polar's buyer terms also apply to the payment. Your access to the service and its content is provided by us under these terms.
• Prices are shown including VAT/GST; the tax is itemised at checkout and on your receipt.
• We may change prices for future billing periods with at least 14 days' notice; a pass you have already bought is not affected.

6. Acceptable use

You may use the content for your own exam preparation. You may not:

• copy, publish, sell or share questions, explanations or other content, or build a question bank from them;
• scrape the service or access it by automated means, except through features we provide;
• attempt to bypass access controls, rate limits or payment; or
• use the service to break the law or to harm others.

We may suspend accounts that break these rules, and will tell you why unless the law prevents it.

7. Your content

You keep ownership of the essays and comments you write. You give us a licence to store and process them to provide the service, including sending essays to our AI provider for feedback. We do not use your essays as public examples, research datasets or model-training material without a separate explicit opt-in. Optional question ratings and comments help improve our questions as described in the privacy policy.

8. Our content

The questions, passages, datasets, explanations, software and design are owned by us or our licensors and are protected by copyright.

9. Availability

We aim to keep GAMSAT Pro available and your work saved, but we do not guarantee uninterrupted service. We may change or withdraw features; if we withdraw a paid feature that is central to your plan, we will offer a pro-rata refund.

10. Liability

Nothing in these terms limits rights you have as a consumer that cannot be excluded by law, including under the Australian Consumer Law and EU, Irish and UK consumer law. Subject to that, our total liability to you is limited to the fees you paid for access to our service in the 12 months before the claim, to the extent that this limit is lawful. We do not exclude liability for fraud, deliberate misconduct, death or personal injury caused by negligence, or any liability that cannot lawfully be limited.

11. Ending the agreement

You can close your account at any time by contacting us. We may end these terms with notice if we stop offering the service, with a pro-rata refund of any prepaid period.

12. Law and disputes

These terms are governed by the laws of Ireland. If you are a consumer, you also keep the protection of the mandatory laws of the country where you live and may bring claims in its courts.

13. Changes and contact

We may update these terms. For significant changes we will notify signed-in users in advance, and continued use after the effective date means you accept them. Contact: support@gamsatpro.com.
